ARTICLE 2 – SUBJECT

The subject of this agreement is the sale and delivery of the product ordered by the BUYER from the SELLER via the website www.klipsan.com.tr and specified below with its characteristics and sales price, in accordance with the Law on the Protection of Consumers No. 6502 and the Regulation on Distance Contracts, and to establish the rights and obligations of the parties.

ARTICLE 3 – PRODUCT SUBJECT TO THE AGREEMENT

The type, quantity, brand/model, color, and sales price of the product(s) are as follows:

ARTICLE 4 – GENERAL PROVISIONS

4.1 The BUYER confirms that they have read and acknowledged the preliminary information on the website regarding the product’s main characteristics, total sales price including all taxes, payment method, delivery details, and that the costs will be covered by the BUYER. By confirming this agreement electronically, the BUYER acknowledges that they have obtained complete and accurate information on these matters prior to the conclusion of this distance contract.

4.2 The product subject to this agreement will be delivered within the timeframe specified in the preliminary information on the website, not exceeding 30 (thirty) days from the order date, depending on the distance to the BUYER’s location or designated recipient. All shipping costs listed on the invoice under “Shipping Fee” will be borne by the BUYER.

4.3 If the product is delivered to someone other than the BUYER, the SELLER is not responsible for non-acceptance by that person or entity.

4.4 The SELLER is not liable for any issues caused by the shipping company that prevent delivery to the BUYER.

4.5 The SELLER is responsible for delivering the product in a complete, intact condition, in accordance with the order specifications, including any warranty documents and user manuals.

4.6 The SELLER may, for valid reasons, supply the BUYER with a product of equal quality and price if fulfillment of the original product becomes impossible before the contract performance period ends.

4.7 In case fulfillment of the order becomes impossible, the SELLER must notify the BUYER before the contract performance period ends and, if available, provide a product of equal quality and price.

4.8 If the order cannot be fulfilled due to the end of a promotional campaign, the SELLER may provide a product of equal quality and price. However, the BUYER cannot claim any further rights if a product is unavailable and the SELLER has offered a replacement or refund in accordance with the contract.

4.9 Delivery of the product requires that the signed copy of this agreement reaches the SELLER and payment is completed using the BUYER’s chosen method. If payment fails or is canceled in the banking system, the SELLER is relieved of the delivery obligation.

4.10 If the BUYER’s payment card or other payment system is used without authorization due to no fault of the BUYER, the BUYER must return the product to the SELLER within 3 (three) days. Shipping costs in this case are the responsibility of the BUYER.

4.11 If force majeure or transport disruptions prevent timely delivery, the SELLER must inform the BUYER, who may cancel the order. Refunds, including shipping, will be completed within 14 (fourteen) days.

4.12 The SELLER reserves the right to cancel orders exceeding consumer needs. For wholesale orders over 3 units, the SELLER may either cancel the order entirely or limit delivery to 3 units.

4.13 In accordance with the Regulation on Distance Contracts dated 27/02/2015, in case of technical errors on the website (e.g., price, description, or product characteristics), the SELLER may cancel the order and refund the amounts paid within the legal timeframe.

4.14 In case of withdrawal, the product amount paid via credit, debit, or other payment systems will be refunded to the bank within 14 (fourteen) days. The reflection of the refund to the BUYER’s account depends on the bank’s processing time.

ARTICLE 5 – RIGHT OF WITHDRAWAL

The BUYER may withdraw from the contract within 14 (fourteen) days of receiving the product without providing any reason.

To exercise the right of withdrawal, the BUYER must notify the SELLER via fax, phone, or email within 14 (fourteen) days, and return the unused product with its original packaging, invoice, and accessories intact. Refund will be made within 10 (ten) days after the SELLER receives the returned product.

ARTICLE 6 – PRODUCTS NOT ELIGIBLE FOR WITHDRAWAL

The right of withdrawal cannot be exercised for:

  • Single-use products, reproducible software, perishable goods, or products with an imminent expiry date.
  • Products prepared according to the consumer’s personal requests.
  • Products whose packaging has been opened and are unsuitable for health or hygiene reasons.
  • Products that cannot be separated due to their nature once mixed.
  • Books, digital content, or computer consumables once unsealed.
  • Subscriptions, newspapers, or magazines.
  • Services or intangible goods delivered instantly online before the withdrawal period ends.

ARTICLE 7 – BUYER DEFAULT

In case of default, the BUYER agrees to compensate the SELLER for any losses. If the default is due to the SELLER’s fault, the BUYER cannot claim damages.

ARTICLE 8 – JURISDICTION

For disputes up to the value announced by the Ministry of Customs and Trade, Consumer Arbitration Committees and Consumer Courts at the SELLER’s location are authorized. By confirming the order, the BUYER agrees to all terms of this agreement.
